| 04/04/2007 | Aligning Concessions for Small Business - Draft Legislation in relation to the Small Business CGT Concessions
The eligibility criteria for Small Business CGT Concessions are to be aligned from 1 July 2007. To be a small business entity, you have to be carrying on a business. This will not cover land holding entities, which simply lease their land to a related entity that conducts the business. While the CGT small business concession rules contain provisions extending the active asset test to such structures, the new rules relating to small business entities do not. To address this difficulty, William Buck recommends extending the rules to entities who lease their assets to a related small business entity. |
